ORDER This appeal was filed on December 13, 1994, by Resource Conservation Corporation (appellant) against the General Services Administration (respondent). Appellant has appealed the denial of its claim for equitable adjustment in the amount of $20,000 for additional asphalt disposal and removal under contract number GS01P93BZC0038 awarded to it for pavement/site improvements and fuel oil storage tank removal in Jackman, Maine. On December 22, 1994, the Board issued an order on further proceedings establishing the filing dates for appellant's complaint, respondent's Rule 4 file, and answer to appellant's complaint. On March 2, 1995, appellant filed a request for a dismissal of its appeal without prejudice. Respondent concurs with the request. Accordingly, pursuant to the request of appellant and Rule 28(b), this appeal is DISMISSED WITHOUT PREJUDICE.
