                                 ORDER
 
        Maron Construction Co.,  Inc., filed this appeal  on October
   20,  1994, from the  contracting officer's decision  of September
   19, 1994.  The dispute involved asbestos at the job site.  
 
        On January 31, 1995, the  parties filed a joint motion under
   Rule  28(a)  for  a  dismissal  without  prejudice.    The  Board
   dismisses without  prejudice the  appeal.  If  the appeal  is not
   reinstated within 180 days from the date of dismissal, the appeal
   will be deemed dismissed with prejudice.
