___________________________________________________ DISMISSED WITHOUT PREJUDICE: July 7, 1994 ___________________________________________________ GSBCA 12885 PLEION CORPORATION, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Faldo Mousalam and Brett A. Alcala of Mousalam & Alcala, Palo Alto, CA, counsel for Appellant. Michael D. Tully, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. PARKER, Board Judge. ORDER On June 23, 1994, the Board docketed this appeal filed by Pleion Corporation, from a decision by a contracting officer for the General Services Administration. Pleion Corporation disputes the price reduction for services performed under contract no. GS- OOF-84009. On July 7, 1994, the Board received a joint request for dismissal without prejudice in lieu of stay or suspension, which provided as follows: Pursuant to Rule 27(c) of this Board, Appellant respectfully requests that, in lieu of issuing an order suspending proceedings, that the Board dismiss the case without prejudice subject to reinstatement within sixty-days. The parties are presently undergoing good faith settlement negotiations. It is Appellant's desire to continue to pursue such discussions directly with the GSA without counsel or Board supervision. Based upon the foregoing Appellant, requests that the Board's dismissal be with prejudice only in the event that the [sic] neither party seeks reinstatement within sixty days from issuance of the order. In accordance with the request of the parties, this appeal is DISMISSED WITHOUT PREJUDICE. Rule 28(a). The dismissal shall convert to a dismissal with prejudice on September 6, 1994, unless it is refiled prior to that date. ________________________________ ROBERT W. PARKER Board Judge
