ORDER This appeal was filed on May 18, 1994, by Meridian Management Corporation against respondent, the General Services Administration (GSA). Appellant was awarded contract number GS- 05P-91-GAC-0168 by the GSA to provide commercial facilities management services at five locations in Michigan. Appellant has appealed the contracting officer's decision upholding the GSA's deductions of $13,528.50 from appellant's contract payments for nonperformance of work. On June 20, 1994, and July 18, 1994, the Board granted two separate motions by appellant for enlargements of time to file its complaint to enable the parties to finalize the terms of a settlement. On August 22, 1994, appellant filed a request for a dismissal without prejudice. Respondent has no objection to the request. Accordingly, this appeal is DISMISSED WITHOUT PREJUDICE. Rule 28(a). This dismissal shall convert to one with prejudice 180 days from the date of this order unless either party moves for reinstatement prior to the expiration of the 180- day period.
