Cavanagh Co. Inc. filed an appeal involving numerous matters which had arisen while the firm was performing a contract for mechanical maintenance of a federal building in Philadelphia, Pennsylvania. The Board issued an interlocutory decision on March 1, 1994, granting in part the Government's motion to dismiss most of the case for lack of jurisdiction. A hearing on the merits of the remaining issues was scheduled for June 30. On June 22, the parties filed a joint stipulation for dismissal, stating that they have entered into a settlement agreement and requesting that the appeal be dismissed without prejudice to reinstatement. The parties further asked that the dismissal be converted to one with prejudice ninety days thereafter unless either party earlier requests reinstatement. The parties' request is hereby granted. The case is DISMISSED WITHOUT PREJUDICE.
