_______________________________________________ DISMISSED WITHOUT PREJUDICE: August 9, 1993 _______________________________________________ GSBCA 12231, 12232 ALABAMA METAL PRODUCTS, INC., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Katherine S. Nucci and Timothy Sullivan of Dykema Gossett, Washington, DC, counsel for Appellant. Wendy Nevett Bazil, Personal Property Division, Office of the General Counsel, General Services Administration, Washington, DC, counsel for Respondent. HENDLEY, Board Judge. ORDER On December 23, 1992, the Board docketed two appeals filed by Alabama Metal Products, Inc., from a contracting officer's decisions of September 30, 1992, denying appellant's claims for various "inside delivery charges" under contract numbers GS-00F- 14203 and GS-00F-14212, which were issued by the respondent, the General Services Administration. Appellant elected to proceed with the appeal, docketed as GSBCA 12232, under the accelerated procedure, Rule 14. On June 8, 1993, appellant filed a motion with the Board to dismiss the appeals. Respondent has no objection. The motion states: On Behalf of Alabama Metal Products, Inc., we hereby request that the above-referenced appeals be dismissed. Appellant's purpose in dismissing the instant appeals is to file new appeals by its newly acquired counsel which will clearly set out its position. Accordingly, the appeals are hereby DISMISSED WITHOUT PREJUDICE. Rule 28(a). The appeals shall be deemed to be dismissed with prejudice on October 5, 1993, unless reinstated with the Board by either party on or before that date. ________________________________ JAMES W.
