ORDER This appeal involves a claim for an equitable adjustment to the price of appellant's construction contract for "security operations improvements" at the Falcon Dam, Texas, U.S. Border Station. The claim is for increased costs incurred in connection with excessive delays alleged to have occurred in the review and approval of contractually required submittals. On June 14, 1993, the parties filed a joint stipulation of dismissal, requesting dismissal of the appeal pursuant to a settlement agreement providing that respondent will pay appellant the amount of $18,000. The agreement provides that the appeal may only be reinstated in the event that payment of this amount is not made by respondent within fifteen days of the effective date of the agreement, which is June 9, 1993. Decision This appeal is DISMISSED WITHOUT PREJUDICE. Rule 28(a). The dismissal shall convert to one with prejudice upon appellant's receipt of payment from respondent or on July 15, 1993, whichever occurs first, unless reinstated by appellant on or before July 15, 1993, and prior to receipt of payment. ______________________________ CATHERINE B.
