ORDER On December 1, 1992, the Board received an appeal filed by BWN Contracting Co., Inc., for $3,660.42, later increased to $5,172.34, as compensation for alleged additional work performed on a renovation contract it had with respondent, the General Services Administration. In response to an agency motion to dismiss for lack of jurisdiction, predicated on the absence of an underlying claim, on January 22, 1992, the appellant recognized that it had not presented a claim to the contracting officer, such that an appealable decision was lacking. The parties jointly requested a dismissal without prejudice, while recognizing that no decision was ripe for Board resolution on the merits. The appeal is DISMISSED WITHOUT PREJUDICE. Rule 28(a).
