ORDER On November 23, 1992, the Board docketed an appeal filed by Sanitation Technicians from a contracting officer's decision of October 8, 1992, claiming $1,400 in overpayment by the respondent, the General Services Administration (GSA), for work under contract number GS05P90SDC0059 at the Social Security Administration Office, Chicago, Illinois. In its notice of appeal, the appellant alleged that the value of extra work it performed under the contract exceeded the amount claimed by the respondent. On December 21, 1992, the respondent orally informed the Board that the parties were settling the appeal and would be requesting dismissal. On January 6, 1993, the Board received a signed settlement agreement and joint stipulation of dismissal from the parties, which states: In accordance with the "Settlement Agreement" between the parties, executed and dated December 23, 1992, and Rule 28(a) of this Board's Rules of Procedure, the parties jointly move this Board to dismiss the subject appeal without prejudice to be converted to a dismissal with prejudice forty-five (45) days after the date of this dismissal without prejudice unless either party moves for reinstatement of the subject appeal within that time period. Accordingly, the appeal is hereby DISMISSED WITHOUT PREJUDICE. Rule 28(a).
