Appellant requested the Board to award it the reasonable costs of filing and pursuing the underlying appeal, including attorneys fees, expert witness fees, and other related costs totalling $96,204.57. On December 10, 1992, the parties informed the Board that they have entered into a settlement of this matter and filed a joint motion to dismiss. Accordingly, appellant's application for costs is DISMISSED WITHOUT PREJUDICE. Rule 28(a)(1).
