                                 ORDER
 
        On July  30, 1992, pursuant  to the Equal Access  to Justice
   Act, 5 U.S.C    504 (1988), appellant  filed its application  for
   costs. Appellant requested the  Board to award it the  reasonable
   costs of  filing and  pursuing the  underlying appeal,  including
   attorneys  fees, expert  witness fees,  and  other related  costs
   totalling $96,204.57.  On December 10, 1992, the parties informed
   the Board that they have entered into a settlement of this matter
   and filed a joint motion to dismiss.
 
        Accordingly, appellant's application  for costs is DISMISSED
   WITHOUT PREJUDICE.  Rule 28(a)(1).  This dismissal shall  convert
   to  one with  prejudice sixty days  from the date  of this order,
   unless either party requests reinstatement prior to that date.
