Order of Dismissal On May 5, 1992, Mr. Daniels filed an appeal from the contracting officer's decision of February 6, 1992, denying a claim for misdescription against contract number GSOWF91FBE3691. That contract was for the sale of an automobile by respondent, General Services Administration. Mr. Daniels, who purchased the automobile at an auction, claimed that the automobile was described as a 1985 model when it was a 1983 model. Mr. Daniels sought a refund of the purchase price, which was $900.00. On September 17, 1992, the parties entered into a settlement stipulation in which respondent agreed to pay appellant $450 to resolve the dispute. Based on the stipulation of the parties, and Rule 28 (a)(1), this appeal is DISMISSED WITHOUT PREJUDICE, to be automatically converted into a dismissal with prejudice unless reinstated within ten calendar days. ________________________________ ANTHONY S.
