_________________________________________ DISMISSED WITH PREJUDICE: March 10, 1993 _________________________________________ GSBCA 11540 STANFORD PROPERTIES, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. John Thompson of Stanford Properties, San Francisco, CA, appearing for Appellant. Jack Christensen, Office of Regional Counsel, General Services Administration, San Francisco, CA, counsel for Respondent. Before Board Judges DEVINE, HYATT, and WILLIAMS. HYATT, Board Judge. This appeal, filed by Stanford Properties on October 22, 1991, is of a contracting officer's decision assessing liquidated damages in the amount of $1,818.16 in connection with a General Services Administration (GSA) auction sale of a 1976 Mercedes Benz convertible. In its notice of appeal, Stanford alleges that it was entitled to "be released from the contract" to purchase the Mercedes because of a misdescription concerning engine work required by the vehicle. The Board issued a docketing order on October 29, 1991. Appellant did not file a complaint. On December 31, 1991, the Government filed an answer to the notice of appeal. Appellant has made no effort to contact the Board or opposing counsel subsequent to the filing of its notice of appeal. On several occasions, the Board has attempted, unsuccessfully, to schedule a telephone status conference in this appeal. Unable to reach appellant by telephone, in a letter dated December 29, 1992, the Board informed appellant that it had no valid telephone number with which to contact it and requested that appellant contact the Board so that a status conference might be scheduled. The Board's letter was returned by the United States Post Office as undeliverable. The Board followed this communication with an order to show cause why the appeal should not be dismissed for failure to prosecute. This order was also returned undelivered. Decision The appeal is DISMISSED WITH PREJUDICE for appellant's failure to prosecute. Rule 28(b)(1). ______________________________ CATHERINE B.
